Terms of Service

Before you may view Prices and Examples, you must agree to the Terms of Service.

Verna Wumpy, also known as Verna Complex and feintofheart, is herein referred to as the Artist.
The end user is herein referred to as the Commissioner.
A Commission is the artwork requested by the Commissioner for the Artist.
A 3D Model ("Model") is a Commission for three-dimensional assets created in Blender and similar modeling applications.

General Terms of Service

Commissions with the following subjects will not be accepted under any circumstances:
Pedophilia, Hate Speech/Discriminatory Content, Bestiality

Pedophilia is defined as:
A Commission featuring an adult and a child with romantic, sexual, or otherwise suggestive connotations.
Hate Speech/Discriminatory Content is defined as:
A Commission featuring messages or symbols that fit under the following categories: Homophobic, Transphobic, Ableist, Racist, Zionist.
Bestiality is defined as:
A Commission featuring humans and adjacent species paired with quadrupedal ("Feral") animals with romantic, sexual, or otherwise suggestive connotations.
Whether or not a Commission is considered to fit under these categories is of the Artist's discretion.

If a Refund is requested by the Commissioner or the Artist must cancel the Commission:
100% Refund will only be provided before the Sketch or Base has been presented to the Commissioner by the Artist.
50% Refund will be provided once the Sketch or Base has been presented up until the Commission is completed and delivered.
NO REFUNDS will be provided once the Commission is complete and delivered.

The Artist reserves the right to decline a Commission for any reason, and is not obligated to provide one to the Commissioner.

The Artist holds zero liability for the Commissioner's (or any other outside party's) actions regarding a commission.

The Commission may not be edited by the Commissioner or other outside parties. The Artist is the only individual permitted to edit a Commission.

All Commission deadlines must be set at least two weeks in advance.
The Artist reserves the right to charge additional fees for deadlines sooner than this minimum.

Payment to the Artist is required to be upfront, paid in full. The Commissioner will not receive the Commission until payment has been received.
Case-by-Case exceptions may be made, and must be arranged in writing between the Artist and the Commissioner directly.
If such arrangements are declined by the Artist, the Commissioner may either cancel their Commission or proceed with the previously listed payment requirement.

Standard Artwork

Artwork (the Commission) from the Artist does not include rights for Commercial Use. However, the Commissioner may acquire these rights for an additional fee, which must be discussed with the Artist.

The Commissioner is entitled to reasonable free revisions. In the case of the Artist correcting an error, no additional charges will be incurred.
The Artist reserves the right to charge additional fees for any complex revisions and/or additions to the Commission that were not agreed upon initially.
What is considered reasonable vs complex is of the Artist's discretion.

A Sketch will be presented before completion of the Commission. This is equivalent to a Base.

3D Models

3D Models, such as User-Generated Content ("UGC") for Roblox are only given Personal Use privileges.
Commercial Use is strictly forbidden unless any additional fees incurred for Commercial Use are paid for upfront and in-full.
Commercial Use for 3D Models is defined as the following:
Any use of a 3D Model that provides income or monetary gain, such as placing the Model for sale/Pay-to-Use.
A Base will be presented before completion of the Model. This is equivalent to a Sketch.

Regarding Terms of Service Violations

If any portion of the above Terms of Service are violated, the Artist reserves the right to the following:
To write warning bulletins (Public Service Announcements, Bewares) visible to outside parties.
To cancel the Commissioner's Commission and provide a Refund accordingly.
To refuse future service regardless of the Commissioner's request.
To request a DMCA take-down upon 3D Model Commissions that are in violation.
